Pre-Sale Certification Inspection Policy

Manheim offers Pre-Sale Certification programs that materially align with industry standards and are available for select vehicles, as further described herein. These inspections may include a limited mechanical guarantee and/or cosmetic considerations, as conveyed to the Seller purchasing them by Manheim. Coverage is dependent on vehicle eligibility and inspection criteria, each as defined by the NAAA Arbitration Policy and adopted by Manheim. Such pre-sale inspections are also subject to the expertise of Manheim inspectors.

This vehicle assessment is a one-time inspection conducted under the vehicle’s operating conditions at such time of inspection; it is not feasible to inspect a vehicle in conditions identical to normal day-to-day operating conditions. Manheim has the right to engage with a third-party vendor if a more specialized inspection is required, in agreement with the auction, Buyer, and Seller. Any cost associated with such additional inspection shall be at Seller’s expense. All vehicles that are inspected under this Policy shall be referred to as a “Covered Vehicle”.

Section 1: Pre-sale Inspection Guarantee

  • Manheim will provide a 10-day limited guarantee of function and/or condition of the Inspected Components of all Covered Vehicles (the “Certification Guarantee”). The Inspected Components are described in Section 4 herein.
    • The ‘Buyer’ of the Covered Vehicle is offered a limited guarantee, as described herein, for a 10-day period, beginning day of sale.
    • Specific Seller-branded programs may vary. Please ask your local auction support for more information.
    • The ‘Seller’ of the Covered Vehicle is not subject to the arbitration process related to the Covered Vehicle.
  • The Pre-sale Certification Guarantee is non-transferable and void if the Covered Vehicle is resold during the Guarantee Period.
  • Covered Vehicles submitted to arbitration under a Certification must have accumulated 300 miles or fewer on the odometer between the time the odometer reading is recorded as part of the pre-sale inspection and the claim date.
  • Manheim performs pre-sale inspections on a good-faith basis and will provide the Limited Guarantee over Inspected Components, whether Manheim provides this directly or in agreement with the Seller. Manheim, in its sole discretion, may elect to either (i) remediate valid claims at auction’s wholesale repair costs if an Inspected Component is found defective during the Guarantee Period or (ii) accept a return of the Covered Vehicle.
  • In the event of a valid claim for a defect related to an Inspected Component that the Certification did not identify, Manheim will reimburse reasonable expenses incurred by the Buyer (excluding profit, commissions, and detail charges) on arbitrated Covered Vehicles. The amount of reimbursement that qualifies under these guidelines will be at Manheim’s sole discretion and will be limited to reasonable, documented expenses at the auction’s wholesale repair cost.
  • Notwithstanding anything herein to the contrary, the Seller remains liable for issues that fall under required disclosures and timelines as per NAAA and Manheim Marketplace policies. Therefore, arbitration with the Seller may occur for issues not related to the Inspected Components, as this  policy does not protect or absolve the Seller from their responsibilities to properly disclose their vehicles under the NAAA Arbitration Policy or Manheim Marketplace policies.
    In the event of such an arbitration, Sellers remain responsible for any arbitrable defects or components that are not related to the Inspected Components or that were not discoverable during the pre-sale inspection

Section 2: Certification Eligible Vehicles

Covered Vehicles must meet the following to be eligible for Certification:

  • Vehicles with less than or equal to 125,000 miles
  • Vehicles with a Clean Title (any title discrepancies post pre-sale inspection could potentially void the Certification for Covered Vehicles)
  • The Vehicle has had a completed InSight Condition Report with Estimates
  • No windshield damage in the line of sight of the driver
  • No warning lights illuminated.
  • The vehicle is less than 20 years old.

The Manheim auction, in its sole discretion, shall determine if any vehicle is eligible for Certification to become a Covered Vehicle.

Section 3: Certification Ineligibility

3.1: General Ineligibility Criteria

The following vehicles are ineligible for Certification:

  • Vehicles over 125,000 miles (Vehicles with higher miles can be certified at the auction’s discretion)
  • Specialty vehicles, including, but not limited to, Kit vehicles, Recreation vehicles, watercraft, motorcycles, and trailers.
  • Vehicles with branded titles or defects that are eligible for a branded title, including, but not limited to: flood damage, salvage, rebuilt, lemon-law or trade-assist buybacks, TMU, et al.
  • Electric Vehicles, unless expressly covered by Appendix A
  • Heavy Duty Trucks & Heavy Equipment categorized with Gross Vehicle Weight Rating (GVWR) of 26,000 pounds or heavier:

Box trucks, such as:

  • The manufacturer makes a vehicle that averages an annual production rate at or below 4,000 vehicles within the three most recently completed production years.

3.3: Performance Modifications

Per section 3.1, vehicles with certain modifications are ineligible for Certification. Examples of certain modifications include, but are not limited to:

  • Modifications that impact the safety of the vehicle
  • Modifications to the 4x 4 system
  • Computer and electrical modifications
    • Including but not limited to computer chips and tuners
      • These modifications will deem a vehicle ineligible for Certification.
      • If found during the inspection, all portions modified and or related to the modifications will cause the inspected vehicle to fail the Certification
  • Physical parts modifications
    • Including but not limited to turbos, catalytic converter deletes and/or replacements, and EGR deletes.
      EGR deletes, high performance or racing alterations
      • OE/OEM-approved modifications will not affect the eligibility of a vehicle for Certification.
      • Non-OE/OEM-approved modifications are deemed ineligible for Certification.
      • If found during the inspection, all portions modified and or related to the modifications will cause the inspected vehicle to fail the Certification.
    • Modifications that don’t allow a vehicle to meet the emission standards in the county or state in which the Certification is performed will cause a vehicle to fail Certification.
  • Altered Suspensions are allowed if properly disclosed by the Seller and/or Certification process to the Buyer
  • All modifications to major components must be announced separately.

3.4: Structural

Structural damage and/or alterations must be announced at auction in accordance with NAAA and Manheim Marketplace guidelines. If Manheim identifies structural damage and/or alterations during the Certification inspection process, the Covered Vehicle must be represented with proper announcements: Structural Damage, Certified Structural Repairs/Replacement, Structural Alterations.

3.4.1: Structural Damage

Definition (per NAAA guidelines): Damage to the structure or a specific structural component of the vehicle. Often referred to as frame damage, although it also applies to Unibody and Unibody on Frame structures, in addition to Conventional Frame.

3.4.2: Structural Alteration

Definition (per NAAA guidelines): An alteration to the vehicle’s structure, including a lengthened or shortened frame, a modified suspension, or the installation or removal of aftermarket accessories.

Section 4: Pre-Sale Certification Inspected Components

All components are inspected with a general understanding of normal wear that is typical for the vehicle’s age, as per manufacturer guidelines. The NAAA Arbitration Policy, as adopted by Manheim, provides the most up-to-date list of Inspected Components. Due to differences in coverage for Specific Seller-Branded programs, some items may not apply.
Manheim performs its inspections based on the NAAA Arbitration Policy and industry’s best practices, with the following caveats:

  • OEM-installed underbody cladding will not be removed from the Covered Vehicle.
  • Covered Vehicles may not be driven at speeds high enough to simulate all driving conditions.
  • Covered Vehicles will not be driven for long durations to simulate extended driving conditions.
  • As part of operational standard practice, Manheim does not conduct full drive cycles; instead, alternative inspection and diagnostics are used to align with industry standards.

The items checked within the Certification include, but are not limited to, the following:

  • Key(s) present and functional
  • Title and Vehicle History
  • Odometer verification
  • Cosmetic Damage and previous repair via Condition Report
  • Windshield condition
  • Tire condition
  • CV Joints and Boots
  • Lights and lamps
  • Warning lights
  • Transmission engages and functions
  • Engine function and operational
  • Drivetrain
    • 4×4 system engagement
    • Differential engagement
  • ABS and brake function
  • Electrical accessories checked for function (For current model year and up to 4 model years old)
  • Emission control equipment is present.
    • The vehicle will be assessed to meet the emission standards in the state in which the Certification is performed.
  • Air conditioning checked for operation.
  • SRS (supplemental restraint system/airbags) check
  • Structure checked.
  • Flood inspection

Advanced Driver Assist Systems (ADAS) are not inspected as part of Certification. If an ADAS issue is present at the time of inspection, Manheim will recommend a 3rd-party vendor to diagnose and provide repair recommendations. Per NAAA guidelines, these systems are recommended to be inspected by a qualified 3rd party outside the auction property. These systems include, but are not limited to, the following:

  • Rear camera
  • Rear parking sensors
  • 360 camera systems
  • Blind spot detection
  • Lane departure warning
  • Adaptive cruise control
  • Collision warning
  • Lane keep assistance
  • Backup Assist
  • Autonomous driving function

Note that Sellers who purchase a Certification are encouraged to discuss the results with the facilitating location.

Section 5: Fail, Claim, and Arbitration Conditions

All Certifications are subject to the following:

  • The Seller is responsible for the Certification fee regardless of the vehicle’s pass or failure.
  • The Buyer is responsible for the Certification fee for any Covered Vehicles purchased.
  • Certification failures are determined by NAAA Certification Standard Guidelines, or Seller-branded guidelines as well as NAAA Arbitration Policy and follow the NAAA repair or replace threshold for all purchases.

5.1: Pass and Fail General

  • Manheim will make the final determination if the Certification is deemed a pass or fail
  • A Certification for any Covered Vehicle is only valid for 60 days from the time of inspection, provided that the Covered Vehicle did not leave the Manheim premises or change owners at that time. After a 60-day period, a reinspection may be required to assess potential lot rot or other condition changes that may have occurred during storage, at Manheim’s sole discretion. Exceptions to this provision include, but are not limited title holds, parts delays, and legal holds. All exceptions shall be in Manheim’s sole discretion.
  • A failed Certification results when the inspected components of a vehicle DO NOT meet NAAA criteria or state or local government safety regulatory criteria, or Manheim policy criteria. Pass/Fail decisions are solely at the discretion of Manheim employees.

5.2: Claim and Arbitration

  • A Covered Vehicle is eligible for claim resolution if:
    • A defective Inspected Component is found within the Guarantee Period, based on the timeframe purchased. Defective Inspected Component is within the scope of the inspection criteria; AND
    • A mechanical defective Inspected Component with an estimated repair cost at or above the NAAA Arbitration Policy threshold (currently $800) to repair or replace, with the estimate based solely on Manheim’s wholesale cost
  • For defect states noted above, the defect must be eligible for claim resolution with Manheim, and Manheim reserves the right to remediate the claim. Eligible claims are based on arbitral items noted in the NAAA Arbitration Policy.
  • Any claim for arbitration under the Certification must be submitted within the Guarantee Period (defined as the time between the sale of the vehicle and the date of claim). If a Covered Vehicle return is required, the Covered Vehicle must be returned within the stated deadline established by the facilitating location in the same or better condition as when sold.
  • Manheim retains the option to assume ownership of a Covered Vehicle at a maximum of 102% of MMR

Section 6: Pre-Sale Certification Inspection Methodology & Non-Arbitrable Items

Manheim’s Certification inspections are based on Manheim’s technicians’ expertise, as well as the utilization of expert source information for items such as repair costs; items inherent to a vehicle based on make, model, year, and other factors (e.g., “known conditions”); and generally accepted practices and standards (e.g., “NAAA guidelines”). Manheim draws its conclusions on a good-faith basis for each inspection from observation, data, and guidance, with the vehicle’s state as-is at the time the vehicle is inspected. All inspections are subject to the discretionary judgment of Manheim and its technicians.

6.1: Specific Non-Material Conditions

Certain temporary or non-material conditions will not qualify a pre-sale inspection for failure, such as:

  • Vehicle scanners returning Yellow (if reason is known)
    • Yellow refers to an indicator light associated with an OBDII scanner that suggests:
      • A previously active code(s) cleared prior to inspection
      • A code(s) not active at the time of inspection
  • Leaks, noise, and other items that are generally considered inherent to an inspected vehicle
    • Per NAAA guidelines (Section 7.k.), oil leaks that are NOT actively dripping and visible by inspection would not require the inspection to fail.

6.2: Non-Arbitrable Items

  • Inherent conditions based on year, make, model
    • Determination of these conditions will be based upon those listed on NHTSA.gov.
  • If the Covered Vehicle is purposefully modified after it leaves the auction location, causing changes to the Covered Vehicle’s condition from the time of inspection, such changes will void the Certification guarantee.
  • Options, accessories, or any items not included in standard base equipment on the OEM make, model trim of the Covered Vehicle.
  • Wearable Items
    • Definition (per NAAA guidelines): defined as parts of the Covered Vehicle that the manufacturer recognizes the need for replacement/adjustment during the expected life of the Covered Vehicle, driven by the average miles per model year (15k). These items are normally identified in the Owner’s Manual for routine check and replacement, including, but not limited to:

Section 7: Rights Reservation

Manheim reserves the right to modify, alter, discontinue, or terminate this policy at any time for any reason whatsoever, with or without notice. In addition, Manheim reserves the right to decline to offer this service to any person or entity at its sole discretion.

Appendix A: Manheim Electric Vehicle Pre-Sale Certification Program

Manheim offers a limited Pre-Sale Certification program for qualifying Electric Vehicles (EVs). With respect to the NAAA guidelines, Manheim’s EV inspection will model the Silver Certification as a baseline for coverage. However, the NAAA has not yet adopted guidelines covering the Certification of electric vehicles.

If a successfully arbitrated issue related to the high-voltage system (battery, motor, cabling, etc.) arises, the transaction will be processed as a seller-buyback and will be returned to the Seller, absolving Manheim of any repair or liability for the vehicle.

In order for Sellers to avail themselves of this program, such Sellers must be approved by Manheim to participate. Sellers must agree to Manheim’s criteria for the Covered EV inspections. Sellers remain solely responsible for high-voltage and propulsion systems of Covered EVs.
In addition to these criteria, all the other criteria in this policy apply to EVs. In the event of a conflict between this appendix and the main Policy, as it relates to Covered EVs, this Policy shall govern.

Electric Vehicle Eligibility

Vehicles must meet the following criteria:

  • Written agreement from Seller for arbitration guidelines
  • Less than 8 years old
  • Less than 100K Miles
  • Any other criteria currently listed in the NAAA Silver Certification Criteria
