Subaru Lemon Law Policy

In September 2022, Subaru of America changed the lemon law policy to state all “Lemon Law” vehicles are sold on “As Is” basis, with no post-sale arbitration nor financial adjustments.

Effective January 1, 2023, SOA has revised the Lemon Law sale policy for vehicles sold at SOA auctions. Vehicles are to be sold under “Green Light”.

Please announce the following four (4) statements at the beginning of all Subaru factory auctions that include lemon law vehicles in the sale offering:

  • All vehicles sold will be eligible for arbitration under NAAA auction arbitration rules. Also, the vehicle will have been repaired to OEM specifications to correct the Lemon Law buyback issue(s).

  • Qualified lemon law vehicles eligible to be placed into Retailer’s Service Loaner (SSLP) fleet. Lemon law vehicles not eligible for inclusion in the Certified Pre-Owned program.

  • Vehicles are covered by an additional warranty when sold to the final retail consumer. The purchaser will receive the balance of the factory warranty (if applicable) or 12 months, 12,000 miles, which ever is greater. (CA residents receive 12 months, unlimited mileage at time of purchase).

  • Subaru Motors Finance (SMF) has a Retailer program to provide financing to your retail customers for lemon law vehicles. Please contact your SMF relationship manager as this program is state specific.
